Easement Application - Fernleigh

The Malvern Hills Trust has received an easement application to serve the property Fernleigh, Jubilee Drive.

In accordance with its guidelines the Trust is inviting members of the public who wish to do so to submit comments that they wish to be taken into consideration when this application is decided. This public consultation is open from Friday 16 July and will close at 23:59 on Sunday 15 August 2021.

Easement applications must be determined in accordance with the Malvern Hills Acts, charity and general law.  In particular when determining the application, the Trust has to have regard to the effect of the works being authorised on the natural aspect of any land under the jurisdiction of the Malvern Hills Trust.  It would be helpful to take account of this when submitting comments.  The Trust cannot take account of wider planning considerations or the impact of granting the easements on any land other than its own.

Public Consultation - This consultation has now closed.

Update - 2nd July 2021 The Malvern Gazette has today reported that the public consultation is open for comments on the below application.  This information is incorrect and the consultation, which was advertised in the Malvern Gazette, on site and on social media, closed on the 18th April 2021.  The Trust were not contacted prior to the publishing of this incorrect information.

In the course of its lifting lockdown restrictions, the Government has not renewed the legislation permitting meetings to be held online.  Whilst some of the rules and advice on indoor meetings, track and trace and social distancing remain in place it will be difficult in practice for the Trust to hold face to face meetings.

The Trust proposes to suspend Board meetings, including a meeting to determine the easement application, until after 19th July when it is anticipated that a number of the restrictions will be lifted but will keep the matter under review and further information will be provided in due course.

Application for easements serving land adjacent to Mill Lane

Malvern Hills Trust have received an application for easements to serve a parcel of land adjacent to Mill Lane. 

These are:

  1. A main access road to a planned development
  2. A second access to serve as an emergency access to the same

In accordance with its guidelines the Trust is inviting members of the public who wish to do so to submit comments that they wish to be taken into consideration when this application is decided. 

This public consultation will run from 19 March to 18 April 2021.
